Fortis Motion ("we", "us", or "our") operates the website fortismotion.com. This policy explains what data we collect, how we use it, and your rights.

1. Who We Are

Fortis Motion is a creative production and media buying agency for ecommerce brands. The data controller is Philippe Maza, operating as a French micro-entreprise (SIRET 924 275 985 00027), Pollionnay (69290), France. For privacy inquiries, contact us at contact@fortismotion.com.

2. Data We Collect

We collect data in two ways:

• Data you provide directly : when you contact us or engage our services (name, email, company, and any information shared during the engagement), or when you email us.
• Data collected automatically : Cloudflare Web Analytics runs cookieless on every page (aggregate metrics, no personal identifiers, no cross-site tracking). PostHog measures pageviews and button clicks cookieless until you accept analytics cookies. With your consent, we additionally use Google Analytics 4 (GA4), Microsoft Clarity (session replay), PostHog with persistent cookies, and the Meta Pixel. This covers pages visited, time on site, referral source, browser/device type, and on-page interactions.

3. Cookies & Tracking

We use a cookie consent banner (CookieConsent v3 by Orest Bida). No analytics or advertising cookies are set without your explicit consent. You can change your preferences at any time by clicking "Manage preferences" in the cookie banner.

• Necessary cookies : required for the site to function. Always active.
• Analytics cookies : Google Analytics 4 (GA4), Microsoft Clarity (session replay), and PostHog. Only set with your consent. Before consent, GA4 and Clarity do not run at all, and PostHog runs cookieless (nothing stored on your device).
• Advertising cookies : Meta Pixel. Only set with your consent. Used to measure ad performance and build audiences.

4. How We Use Your Data

• To deliver the service and communicate with you about your engagement
• To improve our website and understand what content is useful to visitors
• To measure the effectiveness of our advertising
• To respond to inquiries sent via email

We do not sell your personal data. We do not use your data for automated decision-making.

5. Client Account Data

Where we review your store, analytics or email platform, we request read-only access. For running your campaigns, the access level is agreed in writing beforehand and is limited to what the work requires. In both cases the data is used exclusively for your engagement. We do not store, share, or use this data beyond the scope of your engagement. We are happy to sign an NDA upon request.

6. Third-Party Services

• Google Analytics 4 : Google Privacy Policy
• Microsoft Clarity (session replay, consent-gated) : Microsoft Privacy Statement
• PostHog (product analytics, cookieless before consent) : PostHog Privacy Policy
• Meta Pixel : Meta Privacy Policy
• Cloudflare : hosting, cookieless web analytics, and contact form processing. Subject to Cloudflare's Privacy Policy
• Stripe : payment processing when you purchase a service. Stripe Privacy Policy
• Telegram and Notion : contact form submissions are routed to our internal tools (a Telegram notification and a Notion record) so we can handle your request.

Some of these providers process data in the United States (Google, Microsoft, PostHog, Meta, Stripe, Notion). These transfers rely on the EU-U.S. Data Privacy Framework or the standard contractual clauses each provider maintains.

7. Data Retention

We retain contact and engagement data for as long as necessary to deliver the service and comply with legal obligations. You may request deletion at any time by emailing contact@fortismotion.com.

8. Your Rights

Depending on your location, you may have rights under GDPR, CCPA, or similar laws, including:

• The right to access data we hold about you
• The right to correct inaccurate data
• The right to request deletion of your data
• The right to withdraw consent for cookies at any time
• The right to receive your data in a portable format
• The right to object to processing based on legitimate interest
• The right to lodge a complaint with your local data protection authority
• The right to opt out of the sale of personal information (we do not sell data)

9. Security

We take reasonable precautions to protect data shared with us. Access to client accounts is limited to what the engagement requires, and is read-only wherever we are reviewing rather than running. We do not store sensitive credentials.

10. Changes to This Policy

We may update this policy from time to time. The "Last updated" date at the top will reflect any changes. Continued use of the site after changes constitutes acceptance.
